Cardinal Pell appeal ruling to take place next week

The Australian High Court will deliver its ruling on Cardinal George Pell’s appeal against child sexual abuse convictions on April 7.

The cardinal was convicted in 2018 of abusing two choristers in the 1990s, and luges are considering his petition for a special leave to appeal.

The court announced yesterday that a decision would be issued by the seven justices in the Pell v The Crown case at 10AM on April 7.

When the decision is handed down, he bench will have considered the cardinal’s case for over three weeks, after hearing two days of arguments in the case last month.

Conviction

Pell hopes to appeal the 2-1 split decision of the Court of Appeal in Victoria to sustain his conviction on five counts of child sexual abuse over two separate instances.

The High Court heard arguments from both Pell’s legal team as well as state prosecutors on March 11-12.

The cardinal hopes to appeal whether the jury that convicted him could have found him guilty beyond a reasonable doubt, after hearing the case presented by the prosecutors and the defence mounted by Pell’s lawyers.

Appeal

Pell’s lead lawyer, Brett Walker SC, outlined a case for appeal grounded in the findings of Victoria Justice Mark Weinberg, whose dissenting opinion at the Victoria Court of Appeal in August found that the cardinal had been convicted on the evidence of one victim, stating that because of this the jury could not have found him guilty beyond a reasonable doubt.
